1. Welcome to MintPoll
Welcome to MintPoll! These Terms & Conditions (“Terms”) govern your access to and use of the MintPoll website, mobile application, and related services (collectively, the “Service”) provided by Wilphia LLC. By registering for an account or using our Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.
2. Account Registration & Security
To use MintPoll, you must create an account. You agree to:
- Provide Accurate Information: Ensure your registration details are current and accurate.
- Maintain Security: Protect your password and account credentials. You are solely responsible for any activity that occurs under your account.
- Age Requirements: You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account.
3. Subscription, Fees, and Payments
MintPoll offers both free and paid subscription plans.
- Billing Cycle: Paid subscriptions are billed in advance on a recurring basis (e.g., monthly or annually).
- Auto-Renewal: Your subscription will automatically renew unless canceled prior to the end of the current billing cycle.
- Taxes: Prices listed do not include applicable taxes unless specified. You are responsible for any taxes associated with your purchase.
- Refunds: Except as required by law, all fees paid are non-refundable.
4. Acceptable Use Policy (AUP)
MintPoll is designed to facilitate research, feedback, and data collection. We strictly prohibit the use of our Service for malicious, fraudulent, or illegal activities. By using the Service, you agree to the following rules of conduct.
A. Prohibited Content
You may not use MintPoll to create, collect, or distribute surveys, forms, or content that:
- Requests Highly Sensitive Information (Phishing): You may not ask respondents for passwords, full credit card numbers, bank account details, Social Security Numbers (or local equivalents), or any other highly sensitive authentication credentials.
- Is Illegal or Promotes Illegal Acts: Content that violates any local, state, national, or international law, or promotes illicit activities.
- Contains Hate Speech or Harassment: Content that threatens, defames, bullies, or promotes violence or discrimination against individuals or groups based on race, ethnicity, religion, sexual orientation, gender identity, or disability.
- Is Deceptive or Fraudulent: Surveys that impersonate another person or brand, make false claims, or mislead respondents about the purpose of the data collection (e.g., claiming a survey is anonymous when it is tracking IP addresses or emails).
- Distributes Malware: Uploading or linking to viruses, Trojan horses, spyware, or any other malicious code designed to disrupt, damage, or gain unauthorized access to computer systems.
B. Prohibited Actions and Distribution (Anti-Spam)
When distributing MintPoll surveys, you must respect the rights and inboxes of your respondents. You agree not to:
- Send Spam: You may not use MintPoll (or third-party email services linking to MintPoll) to send unsolicited bulk emails, SMS messages, or social media messages.
- Violate Anti-Spam Laws: All survey distribution must comply with applicable anti-spam legislation, including the CAN-SPAM Act, CASL, and the GDPR. You must have prior consent (opt-in) to email respondents where legally required.
- Bypass Security Restrictions: You may not attempt to probe, scan, or test the vulnerability of the MintPoll system, nor may you attempt to breach or bypass our security or authentication measures.
- Use Automated Scrapers: You may not use bots, spiders, or automated scripts to interact with the Service, scrape data, or artificially inflate survey responses.
C. Age Restrictions and Child Privacy
You may not use MintPoll to collect personal data from children under the age of 13 (or the applicable age of digital consent in your jurisdiction) without verifiable parental consent, in strict compliance with the Children’s Online Privacy Protection Act (COPPA) and similar global regulations.
D. Enforcement
We retain the absolute right to monitor surveys and responses. If we determine, in our sole discretion, that you have violated this AUP, we may suspend or terminate your account, delete your surveys, and remove your data immediately and without notice or refund.
5. Content and Data Ownership
We believe your data is yours.
- You (The User) own your survey questions, uploaded media, and all respondent data (“User Content”). You are responsible for ensuring lawful data collection and obtaining necessary respondent consent.
- Wilphia LLC owns the MintPoll software, UI/UX, proprietary templates, branding, and underlying code.
License: By using MintPoll, you grant us a limited, worldwide, secure license to host, process, and display your User Content strictly for the purpose of operating and providing the Service to you.
6. Privacy and Data Protection
Your privacy and the privacy of your respondents are paramount. Our data collection and processing practices are outlined in our Privacy Policy. If you are collecting data from users in jurisdictions with specific data protection laws (e.g., GDPR, CCPA), you act as the “Data Controller” and Wilphia LLC acts as the “Data Processor.”
7. Intellectual Property
Wilphia LLC retains all right, title, and interest in and to the Service, including all related intellectual property rights. You may not copy, modify, distribute, sell, or lease any part of our Service or included software, nor may you reverse engineer or attempt to extract the source code.
8. Disclaimers and Limitation of Liability
- “As Is” Service: MintPoll is provided on an “AS IS” and “AS AVAILABLE” basis. We do not warrant that the Service will be uninterrupted or completely error-free.
- Limitation of Liability: To the maximum extent permitted by law, Wilphia LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, or data resulting from your use of the Service.
9. Termination
- By You: You may delete your account and cancel your subscription at any time through your account settings.
- By Us: We reserve the right to suspend or terminate your account if you violate these Terms, particularly the Acceptable Use Policy.
10. General Provisions
- Modifications: We may modify these Terms occasionally. We will notify you of material changes via email or an in-app notification.
- Governing Law: These Terms shall be governed by the laws of the State of California, without regard to its conflict of law provisions.
